Citing ‘No Lawful Authority,’ Judge Dismisses Cases Against Comey, James

A federal judge in Virginia has dismissed two separate indictments, one against James Comey, the former director of the Federal Bureau of Investigation, and the other of Letitia James, New York State’s Attorney General.
Judge Cameron McGowan Currie ordered the dismissals on the grounds that the Trump administration prosecutor assigned to the cases “had no lawful authority” to present the indictments. As an interim appointee by President Donald Trump, prosecutor Lindsey Halligan, hasn’t been confirmed by the Senate as required by the Appointments Clause of the Constitution.
Judge Currie was nominated by former President Bill Clinton in 1994.
